Arizona ESA Program Faces Fraud Allegations Amid Audit Criticism

In a troubling development for Arizona’s Empowerment Scholarship Account (ESA) program, a father has been charged with fraudulently obtaining over $4,000 by allegedly forging receipts. The accused, Shawn Hantke, is said to have used his child’s account to submit fake receipts for musical instruments to the Arizona Department of Education, covering the period from December 11, 2024, to August 5, 2025.

According to Vanessa Ceja-Cervantes from the Maricopa County Attorney’s Office, Hantke now faces serious legal charges, including one count of Fraudulent Schemes and Artifices, a Class 2 Felony, along with three counts of Forgery, a Class 4 Felony. “Each receipt also contains a tracking number for a delivery that was made before the order was alleged to have been placed,” Ceja-Cervantes explained.

This incident arises amidst ongoing scrutiny of the ESA program. In May, a report from the Arizona Auditor General’s Office highlighted significant administrative lapses by the Department of Education. As detailed in a report by KJZZ, auditors criticized the department for not adequately overseeing the program, particularly pointing out their failure to investigate questionable purchases and the automatic approval of transactions below $2,000.

The audit reviewed 63 transactions from July 2023 to October 2025 and discovered that 25 of them, representing 34% of the total value, were problematic.
