Stricter Regulations Imposed on Short-Term Rentals in Birmingham Following Incident
Short-term rental properties have sparked a diverse range of opinions in Michigan, with some communities struggling to find a harmonious balance. In Birmingham, Oakland County, a recent incident has prompted the city to tighten its regulations on these rentals.
The trigger for this regulatory shift was a shooting at an Airbnb in Birmingham on April 11. Although no one was injured, the incident served as a catalyst for change, prompting residents to voice their concerns about the property at a City Commission meeting. According to Max Bryan, a reporter for The Detroit News, residents had been alerting authorities about the problematic property for some time.
Located in a typical residential area, the property is surrounded by single-family homes. This region, comprising Royal Oak, Troy, Birmingham, and Clawson, is a desirable location for those visiting Detroit, offering proximity to the city’s amenities.
In response to the shooting, city commissioners quickly implemented a 180-day moratorium on new short-term rental properties. While some property owners viewed this as overly restrictive, others acknowledged the necessity for such measures. A local Airbnb owner noted that the company’s relaxed policies made such an incident inevitable.
Following the moratorium, Birmingham’s city attorney announced new regulations that did not require a formal vote. As stated by Mayor Clinton Baller, the city is shifting from a “customer service approach to an enforcement approach.” This means that police officers will now document problematic rental properties and collaborate monthly with the fire department and code enforcement to determine appropriate actions.
Further discussions are anticipated as the Planning Commission explores additional enforcement measures. With residents advocating for stricter controls, Birmingham’s regulatory framework for short-term rentals is likely to become more stringent.
