A Federal Appeals Court Temporarily Halts Arizona Prison Healthcare Takeover

In a significant development concerning Arizona’s prison healthcare system, the 9th Circuit Court of Appeals has issued a temporary halt to a planned receivership, originally set to commence this Monday. The decision arrives as state corrections officials challenge the court-ordered takeover.

The appeals court underscored the potential for “irreparable harm” to Arizona should the state prevail in its appeal. It also highlighted the broader implications regarding the authority of federal judges over state-run facilities.

While the immediate transfer of management has been put on hold, the court clarified that a receiver, an independent corrections expert, may proceed with planning for the future takeover of healthcare operations.

Corene Kendrick, an attorney from the American Civil Liberties Union representing the incarcerated individuals, commented on the state’s resistance: “While the state continues to pull every lever to delay accountability, we remain focused on the underlying crisis and will continue fighting to ensure that people in prison are not needlessly suffering and dying because of the state’s failures.”

Arizona has faced ongoing criticism over its prison healthcare system for the past 14 years, with numerous grievances regarding inadequate management and care. The system has repeatedly failed to implement necessary improvements, leading to harmful and, at times, fatal consequences for prisoners.

In early 2023, U.S. District Judge Roslyn Silver mandated the takeover, asserting that the state had not adhered to court-imposed reforms or constitutional requirements, despite over a decade of legal proceedings. Her findings pointed to severe risks and ongoing suffering among inmates due to systemic healthcare inadequacies.

State legal representatives argue that Judge Silver’s decision for a takeover was extreme, suggesting that less severe measures should have been attempted first. They also contend that the corrections department was not provided with sufficient time to demonstrate further progress.
