Pinal County Attorney Faces Legal Challenge Over ICE Agreement
Pinal County Attorney Brad Miller finds himself at the center of a legal battle after county leaders initiated a lawsuit against him. The dispute arises from Miller’s decision to enter into a controversial agreement with Immigration and Customs Enforcement (ICE) without notifying the County Board of Supervisors.
The agreement in question, known as a 287(g), grants Miller’s office the authority to interrogate individuals regarding their immigration status and detain those suspected of being undocumented. Generally, such agreements are established between county sheriffs and federal authorities, making this arrangement with a county attorney quite unusual.
Despite demands from the Board of Supervisors to terminate the agreement, Miller has refused to comply, asserting that the agreement remains valid. Consequently, the board proceeded with legal action, successfully securing a temporary restraining order against the 287(g) agreement.
On Tuesday, Miller issued a statement contending that the board’s jurisdiction over his role is confined to financial oversight. As an elected county attorney, he maintains that the board lacks the authority to influence his broader responsibilities. He labeled the lawsuit as baseless and emphasized his commitment to collaborating with ICE to combat “the serious threats of human trafficking and drug smuggling that impact our county.”
