In a recent decision that temporarily impacts the accessibility of mifepristone, Supreme Court Justice Samuel Alito has issued an order delaying changes to its prescription process. This decision comes amidst evolving legal discussions regarding how the abortion pill is administered.
Previously, an appeals court had mandated that the Food and Drug Administration (FDA) return to a policy requiring in-person prescriptions for mifepristone, a critical component in medication abortion. This ruling was to take immediate effect nationwide, altering the current process that allows the pill to be prescribed via telehealth and mailed to patients.
Justice Alito’s intervention grants a temporary reprieve from the appeals court order, reinstating the telehealth and mail options for mifepristone prescriptions until next Monday, May 11, at 5 p.m. This pause follows a request for emergency relief from the two companies that manufacture the drug.
Alito also directed all parties involved in the ongoing legal case initiated by Louisiana to submit briefs by Thursday, May 7, at 5 p.m., as the legal battle over mifepristone’s distribution continues.
