Arizona Joins Lawsuit Against $100,000 H-1B Visa Application Fee

In a significant move, Arizona has aligned with 19 other states to challenge a new financial requirement imposed by the Trump administration on H-1B visa applicants. This visa category is crucial for foreign professionals in specialized sectors such as technology and healthcare.

The controversial fee, amounting to $100,000, was introduced through a presidential proclamation in September. Companies wishing to secure H-1B visas for their overseas employees must now meet this financial obligation before their workers can enter the United States.

Arizona Attorney General Kris Mayes has raised concerns about the impact of this fee on rural school districts, including those in Buckeye and Nogales, which utilize H-1B visas to recruit teachers and other essential staff. She emphasized that these districts cannot manage the hefty fee.

Furthermore, Mayes pointed out the potential adverse effects on Arizona’s burgeoning semiconductor industry, especially given the state’s existing workforce challenges. The lawsuit filed by the states contends that the new fee contravenes both the Constitution and the Administrative Procedures Act.
