Legal Battle Over Private Interviews: Biden Challenges Justice Department
In a significant legal move, Joe Biden has initiated a lawsuit against the Justice Department to prevent the dissemination of private interviews conducted with a ghostwriter. These interviews, captured through audio recordings and transcripts, were part of an investigation into his handling of classified documents.
Biden’s legal team filed the lawsuit in the federal court of Washington, arguing that the Department’s intention to release the material to Congress and the Heritage Foundation contradicts previous claims of exemption under public records law.
According to Biden’s attorneys, releasing the recordings would be “an unwarranted invasion of President Biden’s privacy.” They emphasized the right to privacy for all Americans, stating, “Every American, including a sitting or former Vice President, has a right to privacy in the personal conversations he has within his own home.” The Justice Department, having obtained this information during a criminal investigation, is expected to protect it from public disclosure.
The recordings in question are from interviews conducted at Biden’s residence in 2016 and 2017 with Mark Zwonitzer, who collaborated with Biden on his memoirs. These were scrutinized by special counsel Robert Hur during his inquiry into Biden’s handling of classified materials from his tenure as senator and vice president.
Hur’s extensive investigation concluded with a 345-page report, which, while questioning Biden’s age and mental fitness, did not recommend any charges. Hur cited insufficient evidence for prosecuting the case in court.
In a related matter, Biden has contested the release of his interview audio with Hur. In 2024, the House held Biden’s Attorney General, Merrick Garland, in contempt for not providing the audio after executive privilege was invoked by the White House.
Although transcripts of Biden’s five-hour interviews with federal prosecutors were disclosed, they revealed Biden’s serious attitude toward classified information. However, they also highlighted moments where he was unclear on dates and details and unfamiliar with certain document trails.
The situation has sparked a political debate, with Republicans alleging preferential treatment by the Justice Department towards Biden, while contrasting it with the legal challenges faced by Trump over similar document issues. Democrats have highlighted Biden’s cooperation, contrasting it with Trump’s alleged resistance to returning classified documents.
