Immigrant Father and Daughter Released After Unlawful Detention in Montana

The recent release of a father and daughter from immigration detention made headlines after they were arrested during a free school supplies event in Billings, as confirmed by the hosting charity. Andrew Konkel, CEO of United Way of Yellowstone County, shared this information in an email to community groups. The arrests at a backpack giveaway on August 11 led to their 250-mile transfer to a Havre detention facility and subsequent release on legal grounds.

They were freed when a judge ruled U.S. Customs and Border Protection illegally detained them without probable cause. Konkel disclosed that another family was detained after attending the giveaway but was released upon confirming their legal status. These incidents raised concerns about using the event for immigration enforcement.

Konkel wrote that the back-to-back detentions prompted concerns over safety for those seeking help at community events. “We must ensure people can access resources without risking detention,” he emphasized. In response, United Way plans to develop training for local nonprofits on handling immigration authority appearances.

According to a CBP statement, border patrol agents stopped Adrián Espinoza De La Cruz’s car in Billings, leading to his arrest due to illegal status. Released under court order, De La Cruz and his daughter are under supervised release. The CBP encourages illegal immigrants to return voluntarily using the CBP Home app for help.

The annual backpack event serves about 500 children with no residency requirements. In light of the incidents, United Way aims to protect participants’ safety and maintain their trust. “Protecting the safety and dignity of those we serve is central to our work,” Konkel wrote. Efforts will focus on training staff for future events.

A judge found the government’s actions unlawful, ordering the release to address the legal violations. Molly Danahy of Upper Seven Law, representing De La Cruz, praised the decision and vowed to fight against unlawful detentions.
