During the hearing, representatives from the state and the Hemp Industry Trade Association engaged in intense questioning and cross-examination of five witnesses. The core of the debate lies in the legality of selling intoxicating hemp products without the requisite state dispensary license, a point argued by Attorney General Kris Mayes.

In contrast, supporters of the hemp industry maintain that edibles, vapes, and drinks have been legally available in Arizona for years, thanks to the 2018 U.S. farm bill. This legislation has been central to the defense’s argument, emphasizing the legality of these products.

Adding to the complexity, a detective from the Maricopa County Sheriff’s Office provided testimony indicating that the primary focus of law enforcement has been on seizing intoxicating hemp products during their transportation.
