In an unexpected political maneuver, President Trump has disrupted a bipartisan legislative effort, linking it to his controversial election reform proposal. His recent decision has left many lawmakers and analysts questioning the future of key legislation.

Trump halted the anticipated signing of a bipartisan bill designed to alleviate housing costs. He stated that he would endorse the bill only if Congress first approved the SAVE America Act, a piece of legislation facing significant hurdles in the Senate.

This move aligns with Trump’s long-standing position, as he has consistently asserted his refusal to sign any bills until the SAVE America Act passes. This insistence has already derailed other legislative efforts, including those related to surveillance tools and immigration spending.

Despite Trump’s push, the SAVE America Act lacks the necessary support to bypass a filibuster in the Senate. Republican leaders show reluctance to eliminate the filibuster, a step Trump has advocated for to secure the bill’s passage.

The urgency behind Trump’s pursuit of the SAVE America Act is tied to the upcoming midterm elections. He has argued that passing the act would ensure a Republican stronghold in elections for the next five decades, a claim rooted in unsubstantiated allegations of unlawful voting practices by noncitizens, which experts, including those at the Bipartisan Policy Center, have deemed extremely rare.

Key Provisions of the SAVE America Act

1. Proof of Citizenship for Voter Registration

The act mandates documentary proof of U.S. citizenship for voter registration in federal elections. Currently, citizenship verification is already part of the voter registration process, though there are rare instances of system failures.

However, the documentation requirements outlined in the act could be restrictive. A survey revealed that approximately 21.3 million eligible voters might struggle to access such documentation promptly.

A previous attempt by Trump to impose citizenship documentation through an executive order was blocked by a federal court.

2. Photo Identification Requirement

The proposal also requires voters to present valid photo identification at polling stations and attach a copy when voting by mail. Alternatively, voters can provide their Social Security number’s last four digits along with an affidavit.

While voter ID laws generally receive support, the comprehensive changes proposed by the SAVE America Act face mixed reactions from the public.

3. Removal of Noncitizens from Voter Rolls

The act requires states to ensure noncitizens are not listed on voter rolls. While states already perform regular maintenance of these lists, past efforts to purge noncitizens have resulted in errors.

4. Submission of Voter Rolls to Federal Authorities

Another contentious provision mandates states to submit complete voter registration lists to the Department of Homeland Security. These lists include sensitive information, prompting states to resist previous federal requests for such data. Legal efforts to acquire these lists have been consistently blocked in courts.

A recent court ruling further deemed the expanded use of the SAVE system by the Trump administration as unlawful.

5. New Penalties for Election Officials

The legislation introduces penalties for election officials who register individuals lacking citizenship proof, establishing new criminal consequences for such actions.
